Easy to Send's Anti-Spam Policy and Acceptable Use Policy (collectively "Policies")
By utilizing the Site and the Service you expressly agree to comply with our Acceptable Use Policy ("AUP") and our Anti-Spam Policy ("ASP").
Easy To Send is a permission-based email service provider and has a strict anti-spam policy. We do not tolerate the use of our Service to send unsolicited email. If you are found in violation of these Policies, then your access to the Service will immediately be suspended and/or terminated at our sole and absolute discretion.
What qualifies an email address as permissible to send through Easy To Send?
In order to send an email to someone using Easy To Send, you must have clearly obtained their permission to email them along with full disclosure, at the point of collection, describing the type of email they will receive. Acceptable forms of permission include:
- Successful completion of an email newsletter subscription form on your website.
- Someone voluntarily provides you their email address after receiving notice that you will contact them via email.
- An opt-in check box on a form that explicitly states that you will contact them via email.
- Subsequent to the above, anyone who has not requested to be removed from future mailings.
What qualifies as an email address that is NOT permitted to receive email through Easy to Send?
Any email address that was acquired without clear permission and disclosure. In addition, including but not limited to, any email address collected by one of the following means:
- Acquired by misleading content or disclosure;
- Purchased or rented from a third-party whether or not permission was provided for such transfer;
- Harvested from a website, mailing list, or any other means; and
- One who has requested to no longer receive email distributions from you.
Additionally, Easy To Send mailings must adhere to the following guidelines:
- Only be sent to lists of opt-in recipients.
- Provide a physical mailing address in each mailing so end-users may contact you.
- Provide an easy to use and working unsubscribe mechanism in each mailing and immediately honor any removal or unsubscribe requests.
- Never confuse, mangle, or provide misleading or forged email headers, including subject lines and from addresses.
- May not contain any false or misleading content.
- Not contain or transmit any unlawful, harmful, threatening, abusive, harassing, offensive, defamatory, vulgar, obscene, sexually explicit or hateful content or content which is racially, ethnically or otherwise objectionable, or which infringes upon the rights of any third party.
- Not impersonate any person, including but not limited to, an official of Company or an information provider, or communicate under a false name or a name not entitled or authorized to use.
How do we enforce our policy?
- Verify all large lists imported into our software. This includes reviewing signup sources, list age and activity, confirmation practices and any other information that Company, in its sole discretion deems necessary.
- Verify all account emails, from addresses, reply-to addresses, and unsubscribe addresses.
- Assess content and potentially flag messages for words that are common to spam.
- Actively monitor blacklists and abuse accounts.
- Immediately terminate any User's account that has been found, in Company's sole discretion, to be the cause of spam.
- Include a mandatory unsubscribe link at the bottom of every message that cannot be removed.
